Arbitrage Betting Agreement

Terms of Service and Acceptable Use Policy

Use of the Sportspunter Arbitrage Website is governed by the following Acceptable Use Policy. By using the Sports Punter arbitrage betting website, you are agreeing to be bound by the terms of this agreement as a "Subscriber".

Failure to adhere to the terms and conditions listed herein can result in loss of access to your subscription. In such cirumstances, Sportspunter reserves the right to retain any fees already collected for use of the service without any refund. Sportspunter may, but is not obliged to, provide a pro-rata refund on the subscription.

1. Granting of License

The Sportspunter website contains data and documentation for potential arbitrage opportunities, hereafter known as "The Website". Sportspunter hereby grants the Subscriber a non-exclusive, non-transferable, limited license to access the website on one computer at a time for the Subscriber's personal use only.

2. Forbidden Activities

i) International copyright laws protect The Website. All data and documentation may not be

• Copied or transferred to other mediums or other programs
• Shared with other people
• Sub-licensed, rented, leased, lent or otherwise passed on to other people

ii) Accessing The Website from anything other than a typical web browser such as IE or Mozilla is forbidden. Subscribers may not access the data through other programs. This includes, but is not limited to, spreadsheets and 'robots' or other programs that download the data...

iii) Sharing of accounts is prohibited. Only one person may access an account at any one time, and only on one computer. The Subscriber must not give permissions for other people to use their account when they are not using it themselves.

iv) It is not permissable to leave The Website running when Subscriber is not actively using the service. The Subscriber must make every effort to close The Website once they have finished their arbitrage session. Failure to do so may result in temporary suspension of the Subscription, or Termination (see clause 5).

v) Any other behaviour from the Subscriber which can reasonably be construed as not acting as a single-use arbitrage bettor is prohibited.

vi) It is forbidden for anyone to access the service in violation of their State's or Country's laws. Responsibility rests with the Subscriber for contacting their relevant authorities to determine the legality of the Subscriber using The Website.

3. Limited Warranty

Sportspunter makes no guarantees about the accuracy, integrity and availability of The Website. The Subscriber accepts that the information contained on The Website is for informational purposes and only makes representations of potential arbitrage opportunities - it is the full responsibility of the Subscriber to determine if an arbitrage opportunity actually exists.

Sportspunter uses reasonable resource allocation to handle issues and enhances pertaining to The Website, but these resources are sometimes allocated elsewhere which can result in delays to fixing issues on The Website or adding new enhancements.

4. Limited Liability

In no event will Sportspunter be liable to the Subscriber for any damages such as betting losses; other financial losses; or other incidental or consequential damages arising from the use of The Website, including if Sportspunter is aware of possible issues.

If the limitation of liability does not apply to the Subscriber, the Subscriber agrees the total liability for damages (whether in contract, tort, or otherwise) will not exceed the subscription fees paid by the Subscriber for their last subscription.

If the Subscriber is unhappy with the service then they can apply for a pro-rata refund of their subscription, which may or may not be returned in part or in whole at the discretion of Sportspunter.

5. Termination

This license agreement takes effect upon your use of The Website and remains effective until terminated.

The agreement will terminate upon the expiration of the Subscription (with the duration of the Subscription based on subscription fees paid and refunds).

The agreement will also terminate if the Subscriber fails to comply with the terms and conditions of this agreement, in which case Sportspunter is under no obligation to issue any sort of refund.

6. Confidentiality

The Website contains trade secrets and proprietary know-how that belong to Sportspunter and it is made available to the Subscriber in confidence. Any use or disclosure of information (including content, layout and functionality of data) contained implicitly or explicitly on The Website, other than in accordance with this agreement may be actionable as a violation of our trade secret rights.

7. General

(i) This agreement is an exclusive agreement between The Subscriber and Sportspunter concerning the use of The Website. It supersedes any prior agreement or arrangement between the Subscriber and Sportspunter.

(ii) This agreement is governed by the laws of Australia.

(iii) This agreement may be modified by Sportspunter at any time, with a notice placed prominently on The Website. If the Subscriber does not agree to the new agreement then their only possible course of action is to terminate the Subscription and ask for a pro-rata refund of their last Subscription, which may or may not be paid at the discretion of Sportspunter.
